Acceptance of these terms

These Terms & Conditions ("Terms") are an agreement between you and AFHERM LLC ("AFHERM," "we," "us" or "our"). By using www.afherm.com (the "Site"), placing an order, or signing up for any of our programs, you agree to these Terms. If you do not agree, please do not use the Site.

You must be at least 18 years old, or have a parent or guardian's permission, to place an order.

Our products and services

AFHERM offers:

• AFHERM Home products, including Sanctuary, a plant-based spray for hard surfaces, and its refills and gift sets.
• Wellness coaching programs, such as My Healthiest Me. Coaching programs are also governed by the separate client agreement you sign when you enroll. If that agreement conflicts with these Terms, the client agreement controls.
• AFHERM Healthy Spaces, product supply and staff wellness workshops for businesses, provided under the proposal or agreement we send you.

Wellness disclaimer

AFHERM provides wellness education and coaching. We are not a medical provider, and nothing on the Site, in our programs or in our products is medical advice or is intended to diagnose, treat, cure or prevent any disease or condition. Always talk with a qualified healthcare provider before making changes that may affect your health, and never ignore or delay professional medical advice because of something you read or heard from AFHERM.

Using Sanctuary safely

Sanctuary is a home cleaning spray for hard surfaces such as counters, glass, wood, tile, ceramic and stone. Please:

• Use it only on hard surfaces. It contains botanical oils and is not intended for fabric, upholstery or skin.
• Test a small, hidden area first on delicate or unsealed surfaces.
• Keep it out of reach of children, and avoid contact with eyes. If it gets in your eyes, rinse with water.
• Stop using it if you notice any irritation, and contact a healthcare provider if needed.
• Follow the directions on the label and on our website, including how to mix refill concentrate.

Sanctuary is a cleaning product. It is not registered as a disinfectant, sanitizer or pest-control product, and we make no claims that it kills germs or repels pests.

Orders, pricing and payment

All prices are in U.S. dollars. We may change prices at any time, but changes won't affect orders we've already confirmed. Payments are processed securely by our payment processor, Stripe. We do not store your full card number.

We may refuse or cancel an order, for example if an item is unavailable, a price was listed in error, or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full.

Pre-orders. Some products may be offered for pre-order. Your card is charged when you place a pre-order, and we'll ship by the date shown at checkout. If we can't meet that date, we'll let you know and you may cancel for a full refund.

Subscriptions and automatic renewal

If you choose a Sanctuary Refill subscription:

• We'll charge the card on file the subscription price, plus any applicable tax, every 6 weeks (or the schedule you choose) until you cancel.
• Subscriptions have a 3-refill minimum. After your third refill, you may cancel at any time.
• To cancel or change your schedule, email us at [email protected] or use the link in your order emails at least 3 days before your next billing date. Cancellation stops future charges; it does not refund charges already processed.
• We'll email you a reminder before each renewal and give you at least 14 days' notice before any price change.

Founding Circle

The first 25 paid customers of AFHERM Home become Founding Circle members. Founding members keep the price they paid on the same products for as long as AFHERM continues to sell them and their subscription stays active, and they are invited to a private virtual demo with Tiffany. Founding Circle membership is personal and can't be transferred.

Shipping, returns and refunds

Our Shipping Policy and Returns & Refunds Policy are part of these Terms.

Emails and text messages

When you place an order or submit a form, we'll send you messages about your order or request. If you opt in, we may also send marketing emails or text messages. You can unsubscribe from emails using the link in any message, and reply STOP to any text to stop receiving them. Message and data rates may apply, and message frequency varies.

Using our website

You agree not to misuse the Site. This includes trying to access it without permission, interfering with its operation, copying its content for commercial use, submitting false information, or using it for anything unlawful.

Intellectual property

The AFHERM name, logo, the AFHERM Method, Sanctuary, our photos, text, guides and designs belong to AFHERM and are protected by law. You may not copy, sell or reuse them without our written permission. Our product formulas are proprietary.

Disclaimer of warranties

Except where the law does not allow it, the Site, our products and our services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose. Results from coaching and wellness practices vary from person to person.

Limitation of liability

To the fullest extent allowed by law, AFHERM will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site, our products or our services. Our total liability for any claim is limited to the amount you paid us for the product or service that gave rise to the claim.

Indemnification

You agree to defend and hold harmless AFHERM and its owner, team and partners from claims, losses and expenses arising from your misuse of the Site or our products, or your violation of these Terms.

Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to their jurisdiction.

Changes to these terms

We may update these Terms from time to time. We'll post the new version on this page with a new effective date. Changes apply to orders placed after they're posted.
